Ordinance No. 1393, Amending Fridley City Code Chapter 509 Allowing Shared Micromobility Devices, Petitioned by Bird Rides, Inc., Public Hearing and First Reading Motion made by Councilmember Bolkcom to open the public hearing. Seconded by Councilmember Tillberry. UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE MOTION CARRIED UNANIMOUSLY, AND THE PUBLIC HEARING OPENED AT 7:12 P.M. Rachel Workin, Environmental Planner, said Bird Rides is requesting the City to allow foot-powered electric scooter sharing in the right-o-way, and to update the definition in Chapter 509, Motor Vehicle Rental, to include scooters. The text amendment is expanded to include other micromobility devices, right-of-way considerations and removal of motor vehicle language. Motorized foot scooters, bicycles, electric bicycles temporary use for a fee, short trips from right-of-way. The scooters ride 15-18 mph. Similar to the rules to bicycles (MS 169.225). Ride on roads or trails unless posted, must be 12 years old, helmet for <18 years old and equipped with the appropriate lighting. Company specific rules are 18+, helmet use (hard to enforce) and hours of operation. Scooters equipped with GPS, so Bird Rides knows where it is and has the ability to turn off the scooter remotely. Bird Rides, Inc., has locations in 5 Jufn!2/ City Council Meeting 6/28/2021 Minutes Page 3 Minneapolis, Golden Valley, St. Paul and Brooklyn Park (pending). They work with a local fleet operator who charges the scooters, maintains and rebalances them. They receive commission on the scooters. Ms. Workin said the Chapter 509 Text Amendment creates an ordinance license requirement and fee, impoundment and fee and limits the number of licenses. The License Agreement, specific to scooters, limits the number of scooters, duration, creates programs standards, requires insurance and indemnification and reporting. Scooters would need to be removed by October 31. The proposal is for 200 scooter capacity. Golden Valley and St. Louis Park have a maximum of 200 scooters contracting with Bird Rides or 150 and 175 respectively. Minneapolis has a cap of 2,500 split between Bird Rides and Lime. Ms. Workin noted that the license includes vehicle distribution and parking, including highly mobile, geofencing, rebalance in terms of citizen and demand. The City can require redistribution where scooters are too dense or sparse, and scooters are not to be parked where they block pedestrian or vehicular access, on landscaped areas, traffic islands, in the street, where they pose a safety hazard, and are subject to impoundment on private property. Enforcement is direct to local contact where possible. Staff has the ability to impound, decrease the number of scooters and terminate the license. Staff can geofence off high-speed roads over 45 mph speed limits and the operator would get a warning to turn around. Scooters will be removed if unsafe. Specific users can be banned from using the scooters. Indemnity is low risk for licensing, and the user agreement that lays out the risk they are assuming. The licensee must maintain liability insurance and add the City as an additional insured. The Planning Commission approved this and added a stipulation for the user to provide proof of age via drivers' license. Staff recommend Council approve the first reading of Ordinance No. 1393, Amending Fridley City Code Chapter 509 Allowing Shared Micromobility Devices. Councilmember Bolkcom asked who would respond to customers after 10 p.m. Adam Blau, Bird Rides, Inc., replied that during working hours, 9 a.m.-8 p.m., the scooter needs to be moved within two hours. The user can reach out to the 24/7 support line or use email or the app to connect with a Bird Rides representative between 10 p.m. and midnight. The scooter will automatically shut off at midnight. Councilmember Bolkcom asked about staying within 5 feet of scooter. If you wanted to into a store, would you be able to use the scooter when you come back out. Ms. Workin replied that is for an unlicensed City scooter that is unattended, the City could impound that scooter. That does not apply to the licensed-sharing scooters. Councilmember Bolkcom asked if someone could have a passenger on the scooter. Mr. Blau replied that the agreement is for one rider per Bird. Ms. Workin added that it is also illegal in State Statute and not allowed on a private scooter. Councilmember Bolkcom asked if scooters could be taken on a bus. Mr. Blau replied that if busses allowed this it would be okay, but the scooter would remain unlocked, and the user continues to pay by the minute. Locked scooters cannot be transported. 6 Jufn!2/ City Council Meeting 6/28/2021 Minutes Page 4 Ms. Workin said she was not sure if Metro Transit would allow scooters on the bus. Councilmember Bolkcom said there was a lot of discussion at the Planning Commission meeting about liability and if staff felt comfortable with the way the language was written in the ordinance. Andrew Biggerstaff, City Attorney, replied that the language in the license agreement indemnifies the City and the City would be named as an additional insured to provide extra protection for the City. He checked with the League of Minnesota Cities, and this license agreement does not create new lines of liability for the City. Councilmember Eggert asked about the requirements for the insurance certificate. Attorney Biggerstaff replied that there are a number of formats they use in the municipal line. Councilmember Eggert said that someone could get a cheap policy that does not have the assets. Attorney Biggerstaff replied that there is nothing that requires a certain level of rating of the insurer. The City could require that the insurer be someone the City approves of and reviews to make sure they meet our requirements. Councilmember Eggert said he suspected they are with a sizable insurer, and there is a requirement in the license to submit insurance certification. Ms. Workin said staff can look at other City licenses--for garbage and tree trimming--to see examples of the issuer standards the City has required. Councilmember Eggert asked if the insurer would renew on an annual basis. Ms. Workin replied that is managed through Citizen Serve and the licensed applicant uploads a copy of their certificate on an annual basis. Councilmember Eggert said he thought there was a low medical coverage of $10,000. He said that does not cover a lot of medical in today's world. Attorney Biggerstaff replied that the coverage was based on Golden Valley agreement, but staff could look at it and adjust it if needed. Councilmember Eggert asked how any excess costs would be covered. Attorney Biggerstaff replied the indemnity would be beyond the limits and hold the City harmless. The licensee would step in to protect the City. Councilmember Tillberry asked what percentage of riders get injured. Mr. Blau replied 0.001% reported injuries and the industry started in 2018. Councilmember Tillberry asked about the helmet use requirement. 7 Jufn!2/ City Council Meeting 6/28/2021 Minutes Page 5 Mr. Blau replied that they donot mandate helmets but strongly encourage.Riders can get a free helmet on the app and only pay $9.95 for shipping and handling. Ms. Workin added that in the State Statute, helmets are not required unless riders are under 18 years of age. Councilmember Bolkcom asked if there was any way to scan in a student ID rather than a license. Mr. Blau replied that by default, riders are checking a box on the user agreement saying they are 18+. There are a few city partners who would like to require a drivers license, and that may be able to be implemented. Ms. Workin added that age was a concern at the Planning Commission meeting. We learned after the meeting that the identification requirement would have to be a drivers license. The City could require a drivers license identification that could be added into the license. Councilmember Bolkcom thought there should be a way to be able to scan something besides a drivers license. Ms. Workin replied that no other city requires a drivers license. If we could accept other forms of identification, staff would recommend that. If we are limited to drivers license only there would be a rd can follow up to see if they can scan in other types of identification. Councilmember Bolkcom suggested to put emphasis on Bird to develop that technology, to scan other types of identification. Mr. Blau said it is up to City if they want to implement and enforce scanned identification. Councilmember Bolkcom said she did not want Public Safety officers enforcing underage drivers on scooters. Mayor Lund said if the age to ride is 18, why not require a license to be scanned. Ms. Workin replied that not every resident 18+ has a drive license. Mayor Lund asked how someone under 18 would pay for this. credit card. Mayor Lund said there is some work to do, and he was surprised something has not been developed to scan in other identification rather than a drivers license. Ms. Workin replied that the language in the license agreement is similar to Golden Valley and St. Louis Park. They do not require the user to submit identification before renting the scooter. The Planning Commission added a stipulation of additional proof of identification in the form of a drivers license. 8 Jufn!2/ City Council Meeting 6/28/2021 Minutes Page 6 Councilmember Bolkcomsaid that Fridley is going down a new path with a new ordinance.She suggested to start small with those 18 and pressure Bird into doing something different. She asked about impounding the scooter and the notice in the 72-hour ordinance. Ms. Workin replied that if the City received a report of a scooter parked in violation of the notice the City would contact the licensee and they would respond. If something immediate needed to happen like a safety hazard, the City can impound the scooter without notice. City staff reached out to the police department in Golden Valley and St. Louis Park and they said they spent minimal police time, and this If the scooter is impounded that would be done by the community service officers and they wouldn't have to let them know for 72 hours. Bird can track the scooter through GPS so they would know where it is, and Bird would have to pay the fine if there is one. Councilmember Bolkcom asked how the charging stations were regulated. Ms. Workin replied that in the past the City had an incident with illegal home occupation of scooters That is not the current business model. Mr. Blau added that they partner with local businesses and bike shops with existing infrastructure and move scooters back to areas where they will get ridden after they are charged. Councilmember Eggert asked what the rental fee was of the scooters. Mr. Blau replied the fee is $1 to unlock the scooter and 39 cents a minute therafter. Community pricing programs are available for low income individuals and first responders. Mayor Lund agreed to roll this out slowly and not have 5,000 scooters in Fridley. sitting and not being ridden. They would start small with 25-50 scooters and scale up if there is demand. They have more than 200 scooters in this area at one time. Mayor Lund asked where the scooters would be placed. Mr. Blau replied they would defer to the knowledge of local fleet managers and high foot traffic areas. They will track where people start and end from the app. Councilmember Eggert asked how the bad customers are managed. Mr. Blau replied that every rider goes through a tutorial explaining the rules of the road. Information can be can customized within the app. Every rider has to take a photo where they left the scooter. We do fine bad parking and the rider pays. We also have the ability to ban riders from the platform, but the first step is in-app communications. Ms. Workin added that the users are not anonymous. They also have a user profile and credit card trail. Councilmember Ostwald asked if there have been any issues with underage riders using the scooters. Mr. Blau said that is city specific, and he cannot say if there will be an issue in Fridley. 9 Jufn!2/ City Council Meeting 6/28/2021 Minutes Page 7 Councilmember Bolkcomasked how they know if there are underage users with no required proof of identification. Councilmember Ostwald thought this is designed to get cars off the road so they would want a drivers license but that may exclude the group of people without drivers license to use the scooters as alternative transportation. 30% of people in Fridley do not have a vehicle and would be excluded. Councilmember Eggert agreed that we have the infrastructure and our residents need cheaper transportation. Councilmember Ostwald asked what was done to build in security for the scooters. Mr. Blau replied that if the scooters are not unlocked within the app, they are not rideable, and the GPS signal cannot be stopped. Ordinance No. 1391, Amending the Fridley City Code Chapter 206, Building Code (First Reading). Scott Hickok, Community Development Director, stated this is only electrical permit fees. In November of 2020, the State Department of Labor and Industry modified its schedule related to electrical permit fees. From year-to-year, the State looks at its fee schedule for permits and publishes its fee schedule. It is incumbent upon a municipalitto set the fee schedule for that municipality, based on the cost of service. The State fee table becomes an important guide. Mr. Hickok stated that the City has sought to keep all permit fees in line with State requirements that they are set to cover the cost of the service being delivered. An annual report is filed with the State and in includes building department data that helps to define costs incurred (office space, lighting, photocopying, etc.) with our service delivery. Our Plumbing and Building Permit fees do not require adjustment at this time. The State of Minnesota has also created a separate permit process for solar panels and other solar devices. In response, staff has prepared an application which includes a fee chart that will be consistent with other cities across the State. Mr. Hickok said that Robert "Bob" Clausen, has been the contract electrical inspector for the City of Fridley since the late 1960s. Bob is contemplating retirement. For many years, Mr. Clausen was a State Electrical Inspector and later he bacame a contract inspector for cities. In recent years, Bob has worked entirely for the City of Fridley and its surrounding cities and colelcts 80% of the permit fee, leaving 20% to cover : Jufn!2/ City Council Meeting 6/28/2021 Minutes Page 8 administration costs incurred by the City. As he has prepared for his retirement, Bob has made recommendations to Building Official Tony DeForge. Those recommendations include two items; a modified form to be consistent with his other cities where he has contracts and does their inspections and an adjustment to the schedule to bring our fees into line with his other contract cities. Councilmember Ostwald asked when the last time was that we adjusted the rates. Me. Hickok replied that we have kept consistent rates since 1992 and have stayed in the middle compared to other cities. Ordinance No. 1392, Repealing Ordinance No. 1380 Extending the Period of a Mayoral-Declared Local Emergency Wally Wysopal, City Manager stated that the state of emergency order within the City of Fridley is no longer needed so he is recommending repealing the emergency order effective immediately. Motion made by Mayor Lund to adopt Ordinance No. 1392, Repealing Ordinance No. 1380 Extending the Period of a Mayoral-Declared Local Emergency. Seconded by Councilmember Bolkcom. Ordinance No. 1394, Amending Fridley City Code Chapter No. 11 Adding Licensing, Impoundment and Storage Fees for Micromobility Vehicles (First Reading). Ms. Workin said the fees for the micromobility vehicles outlined in Ordinance No. 1393 include micromobility sharing license $25 per vehicle, micromobility vehicle impoundment is $100 per vehicle, and micromobility vehicle storage is $10 per day, with the ability to auction off any scooters held for more than 30 days. Motion made by Councilmember Eggert to approve the first reading of Ordinance No. 1394, made by Eggert, Amending Fridley City Code Chapter No. 11 Adding Licensing, Impoundment and Storage Fees for Micromobility Vehicles. Lund Recording Secretary Mayor 22 Jufn!3/ AGENDA REPORT Meeting Date: July 12, 2021 Meeting Type: City Council Submitted By: Scott Hickok, Community Development Director Tony DeForge, Building Official Title Ordinance No. 1391, Amending the Fridley City Code Chapter 206, Building Code (Second Reading) Background Annually the State Permit Division, a division of the Minnesota Department of Labor, evaluates its fee schedules and makes modifications as necessary to cover costs associated with the inspection, plan review process, and to assure it has considered contemporary electrical applications (Solar PV Systems in this case) and to assure fees cover costs of service. A new fee schedule and application format for both standard electrical permit fees, as well as, Solar PV permit fees was presented relative to this requested Ordinance No. 1391, and the associated fee amendments. The City Council considered and approved the First Reading of Ordinance No. 1391, at their Regular Meeting on June 28, 2021. This is consideration of the second reading and staff recommends approval of Ordinance No. 1391 and the abbreviated summary ordinance version for publication, as submitted. Through this process the State has determined that the Electrical Fees were worthy of adjustment and that there should be a Solar PV System Electrical Inspection Fee Chart. The inspection fees in the case of Solar PV Systems are calculated according to Minnesota Statute § 326B.37, subds. 2, 3, 4, and 6, in . Additionally, Summary Ordinance No. 1391 is Fridley License and Permit Coordinator, Trisha Lindahl has prepared a highlighted fee schedule that shows the modifications that the State made to the standard electrical permit fee schedule (Exhibit A). The changes have been highlighted in yellow. Exhibits B and C are proposed revisions of permit applications reflecting the corresponding new fee schedule. Financial Impact Primarily a pass-thru cost, with a nominal fee adjustment to assist with covering increased administrative and overhead costs associated with permit processing. Recommendation Staff recommends approval of the second reading of Ordinance No. 1391. BUILDING CODE 1. Codes Adopted by Reference The Minnesota State Building Code, as adopted by the Commissioner of Labor and Industry pursuant to Minnesota Statutes (M.S.) The code enforcement agency of this municipality is called the City of Fridley Building Code Enforcement Office. This code shall be enforced by the Minnesota Certified Building Official designated by this Municipality to administer the code in accordance with M.S. § 326B.133, subd. 1. 3. Permits and Fees The issuance of permits and the collection of fees shall be as authorized in Minnesota Rules Chapter 1300. Permit fees shall be assessed for work governed by this code in accordance with the fee schedule adopted by the municipality in City Code Chapter 11. In addition, a surcharge fee shall be collected on all permits issued for work governed by this code in accordance with M.S. § 326B.148. 4. Violations and Penalties A violation of the code is a misdemeanor pursuant to M.S. § 326B.082, subd.16. 5. Building Code Optional Chapters Minnesota State Building Code, Chapter 1300 allows the City to adopt by reference and enforce certain optional chapters of the most current edition of the Minnesota State Building Code. 25 Jufn!3/ The following optional provisions identified in the most current edition of the State Building Code are hereby adopted and incorporated as part of the building code for the City: 1. Chapter 1306, Special Fire Protection Systems 206.02. CONFLICTS In the event of any conflict between the provisions of this Code adopted by the provisions of this Chapter and applicable provisions of State law, rules or regulations, the latter shall prevail. 206.03. PERMITS AND FEES 1. The issuance of permits, and collection of fees shall be as authorized in M.S. § 16B.62, subd. 1. 2. Violations and Penalties. A violation of the code is a misdemeanor (M.S. § 16B.69) and Minnesota Rules Chapter 1300. 3. The fee schedules shall be as follows: A. Plan Review Fees 1) When a plan or other data are submitted for review, the plan review fee shall be 65% of the building permit fee. 2) Where plans are incorporated or changed so as to require additional plan review an additional plan review fee shall be charged. 3) Applications for which no permit is issued within 180 days following the date of application shall expire by limitation and plans and other data submitted for review may thereafter be returned or destroyed. The building official may extend the time for action by the applicant once for a period not exceeding 180 days upon request by the applicant. 4) Permit and Plan Review Refund Policy. The Building Official may authorize refunding of any fee hereunder which was erroneously paid or collected. The Building Official may authorize refunding of not more than 80% of the permit fee paid when no work has been done under a permit issued in accordance with this code. The Building Official may authorize refunding of not more than 80% of the plan review fee paid when an application for a permit for which a plan review fee has been paid is withdrawn or cancelled before any plan reviewing is done. The Building Official shall not authorize refunding of any fee paid except on written application filed by the original permittee not later than 180 days after the date of the fee payment. (Ref 1190) B. Pollution Monitoring Registration Fee 1) Each pollution monitoring location shall require a site map, description and length of monitoring time requested. For matter of definition pollution monitoring location shall mean each individual tax parcel. There shall be an initial application and plan check fee of $25. 2) The applicant for a Pollution Control Registration shall provide the City with a hold harmless statement for any damages or claims made to the City regarding location, construction, or contaminates. 3) An initial registration fee of $50 is due and payable to the City of Fridley at or before commencement of the installation. 4) An annual renewal registration fee of $50 and annual monitoring activity reports for all individual locations must be made on or before September first of each year. If renewal is not filed on or before October first of each year the applicant must pay double the fee. 5) A final pollution monitoring activity report must be submitted to the City within 30 days of termination of monitoring activity. 206.04. INVESTIGATION FEES 33 Jufn!3/ Should any person begin work of any kind such as hereinbefore set forth, or for which a permit from the Building Code Department is required by this Chapter without having secured the necessary permit therefore from the Building Code Department either previous to or during the day where such work is commenced, or on the next succeeding business day when work is commenced on a Saturday, Sunday or a holiday, they shall, when subsequently securing such permit, be required to pay an investigation fee equal to the permit fee and shall be subject to all the penal provisions of said Code. 206.05. REINSPECTION FEE 1. A re-inspection fee of fifty dollars $50 per hour shall be assessed for each inspection or re- inspection when such portion of work for which the inspection is called for is not complete or when corrections called for are not made. 2. This Section is not to be interpreted as requiring re-inspection fees the first time a job is rejected for failure to comply with the requirements of this Code, but as controlling the practice of calling for inspections before the job is ready for such inspection or re- inspection. 3. Re-inspection fees may be assessed when the permit card is not properly posted on the work site, or the approved plans are not readily available for the inspection, or for failure to provide access on the date and time for which inspection is requested, or for deviating from plans requiring the approval of the Building Official. 4. Where re-inspection fees have been assessed, no additional inspection of the work will be performed until the required fees have been paid. 206.06. CERTIFICATE OF OCCUPANCY 1. Except for single family residential structures, a Certificate of Occupancy stating that all provisions of this Chapter have been fully complied with, shall be obtained from the City: A. Before any structure for which a building permit is required is used or occupied. A temporary Certificate of Occupancy may be issued when the building is approved for occupancy but the outside development is partially uncompleted. B. Or before any nonconforming use is improved or enlarged. 2. Application for a Certificate of Occupancy shall be made to the City when the structure or use is ready for occupancy and within 10 days thereafter the City shall inspect such structure or use and if found to be in conformity with all provisions of this Chapter, shall sign and issue a Certificate of Occupancy. 3. A Certificate of Compliance shall be issued to all existing legal nonconforming and conforming uses which do not have a Certificate of Occupancy after all public health, safety, convenience and general welfare conditions of the City Code are in compliance. 4. No permit or license required by the City of Fridley or other governmental agency shall be issued by any department official or employee of the City of such governmental agency, unless the application for such permit or license is accompanied by proof of the issuance of a Certificate of Occupancy or Certificate of Compliance. 34 Jufn!3/ 5. Change in Occupancy: A. The City will be notified of any change in ownership or occupancy at the time this change occurs for all industrial and commercial structures within the City. B. A new Certificate of Occupancy or Compliance will be issued after notification. A $35 fee will be assessed for this certificate. 6. Existing Structure or Use: A. In the case of a structure or use established, altered, enlarged or moved, upon the issuance and receipt of a Special Use Permit, a Certificate of Occupancy shall be issued only if all the conditions thereof shall have been satisfied. B. Whenever an inspection of an existing structure or use is required for issuance of a new Certificate of Occupancy, a $35 fee will be charged. If it is found that such structure or use does not conform to the applicable requirements, the structure or use shall not be occupied until such time as the structure or use is again brought into compliance with such requirements. 206.07. CONTRACTOR'S LICENSES 1. It is deemed in the interest of the public and the residents of the City of Fridley that the work involved in building alteration and construction and the installation of various appliances and service facilities in and for said buildings be done only by individuals, firms and corporations that have demonstrated or submitted evidence of their competency to perform such work in accordance with the applicable codes of the City of Fridley. 2. The permits which the Building Inspector is authorized to issue under this Code shall be issued only to individuals, firms or corporations holding a license issued by the City for work to be performed under the permit, except as hereinafter noted. 3. Requirements Application for license shall be made to the Building Code Department and such license shall be issued upon proof of the applicant's qualifications thereof, willingness to comply with the provisions of the City Code, filing of certificates evidencing the holding of public liability insurance in the limits of $50,000 per person, $100,000 per accident for bodily injury, and $25,000 for property damages and certificates of Worker's Compensation insurance as required by State law and if applicable, list a Minnesota State Tax Identification number. 4. Fee The fee for each license required by the provision of this Section shall be $35 per year. 5. Expiration All licenses issued under the provisions of this Section shall expire on April 30, following the date of issuance unless sooner revoked or forfeited. If a license granted hereunder is not renewed previous to its expiration then all rights granted by such license shall cease and any 35 Jufn!3/ work performed after the expiration of the license shall be in violation of this Code. 6. Renewal Persons renewing their license issued under this Section after the expiration date shall be charged the full annual license fee. No prorated license fee shall be allowed. 7. Specific Trades Licensed Licenses shall be obtained by every person engaging in the following businesses or work in accordance with the applicable Chapters of the City of Fridley: A. General contractors in the business of nonresidential building construction and residential contractors with an exempt card from the State. B. Masonry and brick work. C. Roofing. D. Plastering, stucco work, sheetrock taping. E. Heating, ventilation and refrigeration. F. Gas piping, gas services, gas equipment installation. G. Oil heating and piping work. H. Excavations, including excavation for footings, basements, sewer and water line installations. I. Wrecking of buildings. J. Sign erection, construction and repair, including billboards and electrical signs. K. Blacktopping and asphalt work. L. Chimney sweeps. M. Sanitary Sewer Service Cleaners. 8. Employees and Subcontractors A license granted to a general contractor under this Section shall include the right to perform all of the work included in the general contract. Such license shall include any or all of the persons performing the work which is classified and listed in this Code providing that each person performing such work is in the regular employ and qualified under State law and the provisions of this Building Code to perform such work. In these cases, the general contractor shall be responsible for all of the work so performed. Subcontractors on any work shall be required to comply with the Sections of this Code pertaining to license, insurance, permit, etc., for their particular type of work. 9. Suspension and Revocation Generally 36 Jufn!3/ The City Council shall have the power to suspend or revoke the license of any person licensed under the regulations of this Section, whose work is found to be improper or defective or so unsafe as to jeopardize life or property providing the person holding such license is given 20 days notice and granted the opportunity to be heard before such action is taken. If and when such notice is sent to the legal address of the licensee and they fail or refuse to appear at the said hearing, their license will be automatically suspended or revoked five days after date of hearing. 10. Time of Suspension When a license issued under this Section is suspended, the period of suspension shall be not less than 30 days nor more than one year, such period being determined by the City Council. 11. Revocation, Reinstatement When any person holding a license as provided herein has been convicted for the second time by a court of law for violation of any of the provisions of this Code, the City Council shall revoke the license of the person so convicted. Such person may not make application for a new license for a period of one year. 12. Permit to Homeowner The owner of any single-family property may perform work on property which the owner occupies so long as the work when performed is in accordance with the Codes of the City and for such purpose a permit may be granted to such owner without a license obtained. All rental property permits shall be obtained by licensed contractors. 13. State Licensed Contractor's Excepted Those persons who possess valid State licenses issued by the State of Minnesota shall not be required to obtain a license from the City; they shall, however be required to file proof of the existence of a valid State license together with proof of satisfactory Worker's Compensation and Public Liability insurance coverage. 14. Public Service Corporations Excepted Public service corporations shall not be required to obtain licenses for work upon or in connection with their own property except as may be provided by other Chapters. 15. Manufacturers Excepted Manufacturers shall not be required to obtain licenses for work incorporated within equipment as part of manufacturing except as may be provided by other Sections of this Code. 16. Assumption of Liability This Section shall not be construed to affect the responsibility or liability of any party owning, operating, controlling or installing the above described work for damages to persons or property caused by any defect therein; nor shall the City of Fridley be held as assuming any such liability by reason of the licensing of persons, firms or corporations engaged in such work. 37 Jufn!3/ 206.08. UTILITY EXCAVATIONS (SEWER & WATER) 1. Permit Required Before any work is performed which includes cutting a curb or excavation on or under any street or curbing a permit shall be applied for from the City and shall pay a permit fee as provided in Chapter 11. The Public Works Department shall verify the location of the watermain and sanitary sewer connections before any excavation or grading shall be permitted on the premises. The permit shall specify the location, width, length and depth of the necessary excavation. It shall further state the specifications and condition of public facility restoration. Such specifications shall require the public facilities to be restored to at least as good a condition as they were prior to commencement of work. Concrete curb and gutter or any street patching shall be constructed and inspected by the City, unless specified otherwise. 2. Deposit - Required A. Where plans and specifications indicate that proposed work includes connection to sanitary sewer, watermain, a curb cut or any other disruption that may cause damage to the facilities of the City, the application for permit shall be accompanied by a $200 cash deposit as a guarantee that all restoration work will be completed and City facilities left in an undamaged condition. B. The requirement of a cash deposit shall not apply to any public utility corporation franchised to do business within the City. 3. Maximum Deposit No person shall be required to have more than $400 on deposit with the City at any one time by reason of this Section; provided that such deposit shall be subjected to compliance with all the requirements of this Section as to all building permits issued to such person prior to the deposit being refunded. 4. Inspections A. Before any backfilling is done in an excavation approved under this division the City shall be notified for a review of the conditions of construction. B. During and after restoration the City Engineer or a designated agent shall inspect the work to assure compliance. 5. Return of Deposit The Public Works Director shall authorize refundment of the deposit when restoration has been completed to satisfactory compliance with this Section. 6. Forfeiture of Deposit Any person who fails to complete any of the requirements shall forfeit to the City such portion of the deposit as is necessary to pay for having such work done. 206.09. BUILDING SITE REQUIREMENTS 38 Jufn!3/ 1. General In addition to the provisions of this Section, all building site requirements of the City's Zoning Code Chapter 205 and additions shall be followed before a building permit may be issued. 2. Utilities and Street Required No building permit shall be issued for any new construction unless and until all utilities are installed in the public street adjacent to the parcel of land to be improved and the rough grading of the adjacent street has been completed to the extent that adequate street access to the parcel is available. 3. Manufactured Home Prohibitions Except in a manufactured home or manufactured home park, the removal of wheels from any manufactured home or the remodeling of a manufactured home through the construction of a foundation or the enclosure of the space between the base of the manufactured home and the ground, or through the construction of additions to provide extra floor space will not be considered as conforming with the City's Building Code in any respect and will therefore be prohibited. 4. Equipment and Material Storage No construction equipment and/or material pertaining to construction shall be stored on any property within the City without a valid building permit. When construction is completed and a Certificate of Occupancy has been issued, any construction equipment or materials must be removed within thirty (30) days from the issuance date on the Certificate of Occupancy. 5. Construction Work Hours It shall be unlawful for any person or company acting as a contractor for payment, to engage in the construction of any building, structure or utility including but not limited to the making of any excavation, clearing of surface land and loading or unloading materials, equipment or supplies, anywhere in the City except between the hours of 7:00 a.m. and 9:00 p.m., Monday through Friday and between the hours of 9:00 a.m. and 9:00 p.m. on Saturdays. However, such activity shall be e has been issued by the City upon application in accordance with requirements of the paragraph below. It shall be unlawful to engage in such work has first been issued. Nothing in this Chapter shall be construed to prevent any work necessary to prevent injury to persons or property at any time. 6. Alternate Hours Work Permit Applications for an alternate hours work permit shall be made in writing to the Public Works Director and shall state the name of the applicant and the business address, the location of the proposed work and the reason for seeking a permit to do such work, as well as the estimated time of the proposed operations. No such permit shall be issued excepting where the public welfare will be harmed by failure to perform the work at the times indicated. 7. Safeguards Warning barricades and lights shall be maintained whenever necessary for the protection of 39 Jufn!3/ pedestrians and traffic; and temporary roofs over sidewalks shall be constructed whenever there is danger from falling articles or materials to pedestrians. 206.10. DRAINAGE AND GRADING 1. Investigation After a building permit has been applied for and prior to the issuance of said permit, the City shall thoroughly investigate the existing drainage features of the property to be used. 2. Obstruction of Natural Drainage Prohibited No building permit shall be issued for the construction of any building on which construction or necessary grading thereto shall obstruct any natural drainage waterway. 3. Undrainable Lands No building permit shall be issued for the construction of any building upon ground which cannot be properly drained. 4. Protection of Existing Drainage Installations A. Where application is made for a building permit and subsequent investigation shows that the property to be occupied by said building is adjacent to a portion of a public road or street containing a drainage culvert, catch basin, sewer, special ditch or any other artificial drainage structures used for the purpose of draining said property and/or neighboring property, the applicant shall specifically agree in writing to protect these waterways in such a way that they shall not be affected by the proposed building construction or grading work incidental thereto. B. No land shall be altered and no use shall be permitted that results in water run-off causing flooding, erosion or deposits of minerals on adjacent properties. Stormwater run-off from a developed site will leave at no greater rate or lesser quality than the stormwater run-off from the site in an undeveloped condition. Stormwater run-off shall not exceed the rate of run-off of the undeveloped land for a 24-hour storm with a one-year return frequency. Detention facilities shall be designed for a 24-hour storm with a 100-year return frequency. All run-off shall be properly channeled into a storm drain water course, ponding area or other public facility designed for that purpose. A land alteration permit shall be obtained prior to any changes in grade affecting water run-off onto an adjacent property. 5. Order to Regrade The City may order the applicant to regrade property if existing grade does not conform to any provision of this Section, if the grade indicated in the preliminary plan has not been followed, or if the grade poses a drainage problem to neighboring properties. 206.11. WATERS, WATERWAYS 1. Definition As used in this Section, the term waters and/or waterways shall include all public waterways as 3: Jufn!3/ defined by M.S., § 105.38 and shall also include all bodies of water, natural or artificial, including ponds, streams, lakes, swamps and ditches which are a part of or contribute to the collection, runoff or storage waters within the City or directly or indirectly affect the collection, transportation, storage or disposal of the storm and surface waters system in the City. 2. Permit Required No person shall cause or permit any waters or waterways to be created, dammed, altered, filled, dredged or eliminated, or cause the water level elevation thereof to be artificially altered without first securing a permit from the City, State or watershed management organization as appropriate. 3. Application for Permit Applications for permits required by the provisions of this Section shall be made in writing upon printed forms furnished by the City Clerk City Manager or their designee. 4. Scope of Proposed Work Applications for permits required by this Section shall be accompanied with a complete and detailed description of the proposed work together with complete plans and topographical survey map clearly illustrating the proposed work and its effect upon existing waters and water handling facilities. 5. Fees A fee of $25 shall be paid to the City and upon the filing of an application for a permit required by the provisions of this Section to defray the costs of investigating and considering such application. 206.12. PENALTIES Any violation of this Chapter is a misdemeanor and is subject to all penalties provided for such violations under the provisions of Chapter 901 of this Code.
