UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON BETZOLD DECLARED THE MOTION CARRIED UNANIMOUSLY AND THE MINUTES APPROVED AS AMENDED. 1. PUBLIC HEARING: CONSIDERATION OF A SPECIAL USE PERMIT, SP #92-09, BY NANCY AND PATRICK THOMPSON: Per Section 205. 07. O1.C. (1) of the Fridley City Code, to allow a second accessory building over 240 square feet, on Lot 9, Block 3 , Shorewood, generally located at 851 West Moore Lake Drive N.E. MOTION by Mr. Kondrick, seconded by Mr. Saba, to waive the reading of the public hearing notice and open the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON BETZOLD DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 8:01 P.M. Ms. McPherson stated the property is zoned R-1, Single Family Dwelling, as are all the adjacent properties. The petitioners are proposing to construct a detached 22 ft. by 24 ft. second accessory building. They currently have a single car attached garage which fronts onto West Moore Lake Drive. The second garage is needed to store additional vehicles. The structure, as proposed, meets all the setback requirements for detached accessory structures in the rear yard. The accessory structure may not exceed 14 feet in height, and it cannot be used for a home occupation as defined in Section 205. 03 . 34 Ms. McPherson stated staff recommends that the Planning Commission recommend approval of the special use permit request with the following stipulations: 1. The accessory building shall be architecturally compatible with the existing dwelling unit. 2 . The petitioner shall provide a hard surface driveway by August 1, 1993 . 3 . The accessory structure may not exceed 14 feet in height. 4 . The accessory structure may not be used to conduct a home occupation as defined in Section 205. 03 . 34 of the Fridley Zoning Code. Mr. Saba stated there is a storage shed in the rear yard. Will that be removed or will it stay? Ms. Thompson stated the storage shed will probably remain. Ms. McPherson stated that keeping the storage shed will not adversely impact the lot coverage. Mr. Betzold asked the petitioner if she had any objection to the stipulations proposed by staff. Ms. Thompson stated she had no problem with the stipulations. MOTION by Mr. Saba, seconded by Ms. Sherek, to close the public hearing. In addition to the special use permit request, the petitioner has applied for a variance to reduce the rear yard setback from 29 feet to 8 feet. The Appeals Commission reviewed the variance request at their October 6, 1992 meeting. The requests are for Lots 31 and 32, Block S, Riverview Heights, generally located at 8141 Riverview Terrace N.E. Site Located on the property is a one story single family dwelling unit with an attached single car garage. The property is zoned R-1, Single Family Dwelling, as are all adjacent properties. Analysis - The petitioner is proposing to expand the existing single car garage to a three stall garage. The proposed addition is 20' x 24 ' . The Appeals Commission recommended to the City Council that a variance be approved to reduce the rear yard setback from 29 feet to 18 feet to allow the expansion of the existing garage to a two car garage. Section 205.24.05 requires that a special use permit be issued to allow construction of structures in the CRP-2 (Flood Fringe) District. Structures for habitation are required to be constructed at an elevation a minimum of one foot above the regulatory flood elevation. However, accessory structures, such as garages, may be constructed below the regulatory flood elevation. The ordinance requires that the accessory structure be flood-proofed in accordance with the flood-proofing standards to the height of regulatory flood elevation. The proposed accessory structure could be constructed to meet these requirements. The City Attorney is currently researching whether the City can require dedication of a 20 foot easement along Riverview Terrace. We hope to have an update by Wednesday's meeting. In conjunction with the plat request, the petitioner has also applied for three variances: 1. To reduce the rear yard setback from 40 feet to 0 feet. 2. To reduce the required number of parking spaces from 102 to . 13. 3. To increase the maximum size of a free-standing sign from 80 square feet to 120 square feet. The Appeals Commission reviewed the variance request at its October 6, 1992 meeting, and recommended approval of the variance request to the City Council. Analysis During original consideration of the proposed redevelopment, Bob's Produce was to lease the property to Lyndale Garden Center and retain ownership of the entire redevelopment site. The current request is generated by Lyndale Garden Center to create its own lot for fee simple ownership. The request is more complicated but similar to the request by Skywood Mall and the Kelly Inn to divide ownership along a zero lot line. Unlike Skywood, the buildings are at a. 90 degree angle to one another versus at the same building line. The variances are necessary due to creation of the new lot line between the two buildings. As discussed in the previous request for this project, the project has a unique shape and contains the Metropolitan Waste Control Commission and St. Paul Waterworks easements. A typical subdivision cannot occur due to these factors and the location of the existing building. The proposed lots meet the minimum lot area (Lyndale Garden Center is 66,781 square feet) and lot width requirements for the C-3, General Shopping Center District regulations. The proposed Lyndale Garden Center lot could accommodate 97 parking spaces should Lyndale Garden Center vacate the proposed building redevelopment. This does not meet the parking requirements; however, it is only five spaces short of the requirements (102) . As the lots will still function as one development, cross parking and access easements will be required to be recorded against both lots. Staff Report P.S. #92-06, by Mike/Robert Schroer; East Ranch Estates Page 3 The rear yard variance is to 0 feet., however, there will be a minimum of 85 feet between the Lyndale Garden Center building and the building located on Lot 5, Block 2, East Ranch Estates 2nd Addition. A side yard variance is not necessary since zero lot lines are permitted in the C-3, General Shopping Center District. The petitioners will be required to submit a drainage plan and appropriate drainage calculations for the entire development parcel. A detention pond will need to be created in the northerly- most portion of the site. The petitioners will be required to execute a maintenance agreement regarding the detention pond. The petitioners will also be required to submit a landscape plan in conjunction with the redevelopment of the subject parcel. Recommendation Staff recommends that the Planning Commission recommend approval of the plat request, P.S. #92-06, with the following stipulations: 1. Variance request, VAR #92-21, shall be approved. 2. The petitioner shall execute cross parking and access easements between Lot 1 and Lot 2, Block 1, Lyndale Garden Center Addition. 3. The petitioner shall submit a drainage plan and drainage calculations for the redevelopment parcel. 4. The petitioner shall execute and record against Lot 1, Block 1, Lyndale Garden Center Addition a detention pond or storm water pond maintenance agreement. Conformance to the Comprehensive Plan Compatibility with Adjacent Zoning and Uses Environmental Considerations RECOMMENDATION Staff Approval Appeals Commission Planning Commission Author MM/dn v Staff Report ZOA #92-06, by City of Fridley Page 2 Request The City of Fridley is rezoning certain properties which are generally located between 79th and 83rd Avenues, the Burlington Northern Railroad, and Main Street, from M-2, Heavy Industrial to M-3, Outdoor Intensive, Heavy Industrial. Analysis The City of Fridley recently adopted a third industrial zoning classification entitled "M-3, Outdoor Intensive, Heavy Industrial" . The purpose of the zoning district is to provide a separate district for those uses which require large amounts of outdoor storage. Specifically, these uses include trucking terminals and construction yards. The City desires to have more control over where these types of uses are located within the City. Three options were evaluated prior to adoption of the current ordinance. The options included: A. Create the M-3 zoning district in text only. B. Create the M-3 zoning district in text and on map. C. Maintain current ordinances. Option B was chosen, and the rezoning completes the second part of the option. The M-3 district also allows all of the permitted uses in the M-1 and M-2 districts. While adopting the M-3, Outdoor Intensive, Heavy Industrial zoning district regulations, the City also amended the M-1, Light Industrial and M-2, Heavy Industrial zoning district regulations in order to eliminate the outdoor intensive uses from those districts. The properties to be rezoned contain outdoor intensive uses and they are generally located north of 79th Avenue, west of University Avenue, and east of the railroad tracks. The adjacent roadways have been designed to accommodate the amount of daily truck traffic in the area associated with these uses. It is the City's opinion that this area of the community is best suited for the M-3 , Outdoor Intensive, Heavy Industrial zoning classification.
