Resolution No. 2022-99 Declaring Costs Assessed for Stereet Rehab Proj ST-2021-01 Resolution No. 2022-99 Resolution Declaring Costs to be Assessed, Ordering the Preparation of the Proposed Assessment Roll and Directing Publication of a Public Hearing Notice for Street Rehabilitation Project No. ST-2021-01 Whereas, a contract has been let for Street Rehabilitation Project No. ST-2021-01 and the contract priced for such improvement is $823,932, and the expenses incurred or to be incurred in the making of such improvement amount to $25,321 so that the total cost of the improvement will be $849,253; and Whereas, by resolution passed by the City Council (Council) on September 12, 2022, the City Clerk, with the assistance of the City Engineer and City Treasurer, was directed to prepare a proposed assessment of the cost of Street Rehabilitation Project No. ST-2021-01; and Whereas, the City Clerk, with the assistance of the City Engineer and City Treasurer, has notified the Council that such proposed assessment has been completed and filed by their office for public inspection. Now, therefore be it resolved, by the City Council of the City of Fridley, Minnesota: 1. The portion of the cost of such improvement to be paid by the City is hereby estimated to be $334,053 and the portion of the cost to be assessed against benefited property owners is declared to be $515,200 for a total cost of $849,253. 2. Assessments shall be payable in installments extending over a period of 10 years, the first of the installments to be payable on or before the first Monday in January, 2023 and shall bear interest at the rate of 7.50 percent per annum from the date of the adoption of the assessment resolution. 3. The City Clerk, with the assistance of the City Engineer and City Treasurer, shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, as provided by law, and they shall file a copy of such proposed assessment in their office for public inspection. Be it further resolved: 1. A hearing shall be held at 7:00 p.m. on October 10, 2022 in the City Hall located at 7071 University Avenue Northeast to pass upon such proposed assessment. All persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. Resolution No. 2022-99 Page 2 2. The City Clerk, with the assistance of the City Engineer and City Treasurer, is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official publication at least two weeks prior to the hearing and they shall state in the notice the total cost of the improvement. They shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearings. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county, pay the whole or any part which is not less than one–half thereof, provided that such partial payment shall in any event be in a sum of at least one hundred dollars ($100.00) of the assessment on such property, with interest accrued to the date of payment, to the City of Fridley, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment. Upon receipt of any such prepayment, the City Clerk, with the assistance of the City Treasurer, shall note the same upon the records of the City, credit the payee therefore, and reduce the assessment as originally made in the amount of the prepayment received. The balance remaining shall then be noted as the amount due and may then be certified to the county together with and as a part of the assessment roll in which the original amount due was contained. A property owner may at any time, thereafter, pay to the City of Fridley the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. Lund – Mayor Attest: Melissa Moore – City Clerk Resolution No. 2022-102 thth Award of 7 Street and 57 Avenue Trail Project thth Whereas, the 7 Street and 57 Avenue Trail Project (Project) has been incorporated into the City of Fridley’s Capital Investment Program; and Whereas, the City of Fridley (City) has developed an Active Transportation Plan that identifies thrdst improvements to promote multi-modal travel along 7 Street from 53 Avenue to 61 Avenue thth and 57 Avenue from 7 Street to Trunk Highway 47; and Whereas, outreach to the adjacent neighborhood by City staff to receive feedback included a hosted onsite event in June 2017 and a hosted open house in October 2019; and thrd Whereas, the City has successfully obtained federal funding to improve 7 Street from 53 stthth Avenue to 61 Avenue and 57 Avenue from 7 Street to Trunk Highway 47; and Whereas, the 2040 Comprehensive Plan and Active Transportation Plan has identified these thth segments of 7 Street & 57 Avenue to be in need of pedestrian and bicycle facilities. Now, therefore be it resolved, that the City Council of the City of Fridley hereby approves thth received bids per the attached bid tabulation and award the 7 Street and 57 Avenue Trail Project to the lowest responsive bidder, Thomas and Sons Construction of Rogers, MN in the amount of $1,018,791.22. th Passed and adopted by the City Council of the City of Fridley this 26 day of September, 2022. _______________________________________ Scott J.
