Resolution No. 2023-46, Making a Determination on the Objection Received from Patricia Rein Regarding 1559 N. Oberlin Circle NE with Respect to the Innsbrook North Housing Improvement Area Resolution No. 2023 - 46 Making a Determination on the Objection Received From Patricia Rein Regarding 1559 N Oberlin Circle NE With Respect to the Innsbrook North Housing Improvement Area Whereas, the Fridley City Council (Council) is considering adopting an ordinance establishing the Innsbrook North Housing Improvement Area (HIA) pursuant to Minnesota Statutes (M.S.) § 428A.13, subd. 1; and Whereas, a duly noticed public hearing on the HIA was held by the Council on April 24, 2023; and Whereas, pursuant to M.S. § 428A.13, subd. 4, before the HIA ordinance is adopted or at the hearing at which it is to be adopted, the owner of a housing unit in the proposed HIA may file a written objection with the City Clerk asserting that the owner’s property should not be included in the area or should not be subjected to a fee and objecting to the inclusion of the housing unit in the area, for the reason that the property would not benefit from the improvements; and Whereas, on April 22, 2023, the City Clerk received a written objection from Patricia Rein, the owner of the property located at 1559 N Oberlin Circle NE, which is within the HIA; and Whereas, Patricia Rein also spoke at the public hearing on April 24, 2023; and Whereas, M.S. § 428A.13, subd. 4 requires the Council to make a determination of such an objection within 60 days of its filing. Now, therefore it be resolved, by the City Council of the City of Fridley, that as required by M.S. § 428A.13, subd. 4, the Council makes the following determination of Patricia Rein’s objection: 1. Patricia Rein’s property will benefit from the improvements that will be completed as a result of the HIA. 2. In particular, Patricia Rein’s property will receive the following benefits: (a) A new street with new curbs and gutters. (b) A new driveway with a concrete apron in front of the property’s garage. (c) Cured-in-place lining for the sanitary sewer that serves the property. (d) The asphalt trail through the green area to the south of the property will be replaced with a concrete sidewalk which will have concrete steps. This will allow much better access to the green area. Resolution No. 2023-46 Page 2 (e) The asphalt trail from East Oberlin Circle to Meister Road will also be replaced with a concrete sidewalk. This will allow easier and safe pedestrian access by residents to the Community Center. (f) The tennis courts will be replaced with a new green area that will be available to all residents. th Passed by the City Council of the City of Fridley, Minnesota this 8 day of May, 2023. ________________________________________ Scott J.
