Draft Ordinance No. 1408, Adopting an Emergency Ordinance for a Moratorium on THC and
Intoxicating CannabinoidProducts
Background
At the September 12, 2022City Council Conference Meeting, staff presented information to the
Fridley City Council (Council) related to anticipated changes to State law regarding the
legalization of THC and intoxicating cannabinoid products.
A bill to legalize cannabinoid products has significant support by the State legislature. Staff
anticipate such a bill to be enacted soon. Staff have remained abreast of developments,
conducted a significant amount of research, and consulted with the City Attorney.
Staff have determined that placing a moratorium on the retail sale of THC productsand
intoxicating cannabinoid products is necessary to allow for more time to determine what, if any
additional licensing and/or regulations ofcannabinoidproducts the City would like to pursue.
Section 3.06 of the Fridley City Charter allowsthe Council to pass emergency ordinances if the
The moratorium will protect the
health, safetyand welfare of residents to allow the City to study zoning implications (where a
business may be located and/or how many) and licensing regulations(how such businesses may
conduct business in the City). Minnesota Statute § 462.355, subd. 4 allow municipalities to enact
moratoriums for one year. It will allow the City to review the new laws established by the State
and determine the best course for prudent regulation of a new industry. The moratorium will
expireMay 22, 2024.

Ordinance No. 1408
Adopting an Emergency Ordinance for a Moratorium on THC and Intoxicating Cannabinoid
Products
The City Council of the City of Fridley does ordain, after review, examination and staff
recommendation thata moratorium on cannabinoid products be enacted as follows:
Section 1 Declaration
Pursuant to the Fridley City Charter Section 3.06, an emergency declaration is warranted due to
the extremely rapid and inevitable legalization of THC and intoxicating cannabinoid products in
the State. There are many unknown variables in the legislation that are of concern to the Fridley
City Council (Council) related to protecting the health, safety and welfare of the residents of the
City of Fridley (City).
Section 2 Purpose
The Council finds that an ordinance placing an emergency moratorium on the retail saleof THC
productsandintoxicating cannabinoid productsis necessary to protect the health, safety general
welfare of the citizens of the City.
The City further finds that anordinance establishing an emergency moratorium on theretailsale
of products containing tetrahydrocannabinol(THC), tetrahydrocannabinolacetate (THC-O),
Tetrahydrocannabivarin(THC-V), hexahydrocannabinol (HHC), tetrahydrocannabiphorol
(THC-P or THC-Heptyl), tetrahydrocannabioctyl(THCjd), tetrahydrocannabihexol(THC-H),
and cannabinol(CBN) will allow the City time to study the issue and determine what, if any,
additional licensing and/or regulations for these Cannabinoidproducts to pursue.
Section 3Summary
The City Council does herby ordain:
No individual, establishment, organization, or business may sell products containing HC, THC-O,
THC-V, HHC, THC-P, THC-Heptyl, THCjd, THC-H and CBNfor12 months from the effective date
of this Ordinance. This moratorium does not apply to the sellingof products containing THC
related to the Medical Cannabis Program as administered by the Minnesota Department of Health,
provided that such activity is done in accordance with the regulations and laws of Minnesota
regarding Medical Cannabis.
Unless rescindedby action of the Council, the moratorium prohibiting theretailsaleof products
containing HC, THC-O, THC-V, HHC, THC-P, THC-Heptyl, THCjd, THC-H and CBNas established
by this Ordinance willremain in full force and effect until May 23, 2024. The moratorium may be
extended as provided in Minnesota Statute§462.355, subd. 4(d).

Locke Lake Dredging
Background
City staff has had some recent discussions with the Rice Creek Watershed District relating to their new
Watershed Management Plan and future maintenance and improvement projects on Locke Lake. We
would like to brief the City Council on these discussions, present our proposed activities, and brief the
Council on development of an action plan relating to this.
