David Carlson commented that he spoke at the last Council meeting related to concerns he had with prior abuse of his children. He provided more details on what occurred with his children and a concern that he has that the couple adopting his daughter may be connected to others he has concerns with. Mayor Lund said he was not sure that the City would be able to assist. He asked and received confirmation that Mr. Carlson has spoken with the Police Department. He also confirmed that Mr. now over 18. Councilmember Tillberry commented that he is unsure where the City Council would fit into this picture, and stated that perhaps Mr. Carlson would be better served by bringing his concerns to an attorney. Public Hearing to Consider On-Sale Liquor License by Debesay Girmalul for Continental Restaurant and Resolution No. 2024-42, Approving On-Sale Liquor License for Continental Restaurant. 33 Jufn!4/ City Council Meeting 4/8/2024 Minutes Page 3 Motion made by Councilmember Tillberryto open the public hearing. Seconded by Councilmember Evanson. Upon a voice vote, all voting aye, Mayor Lund declared the motion carried unanimously. Beth Kondrick, Deputy City Clerk, presented the application for an On-Sale Liquor License from Debesay Girmalul for the Continental Restaurant. She reviewed the background and analysis of the request, stating that staff recommends approval of the request following the public hearing. Debesay Girmalul, applicant, commented that in this location he currently has the food service license and would now like to obtain the necessary license to serve alcohol. He stated that his intent is not to focus on just alcohol, but to offer that in addition to his food menu. He commented that he would continue to run his business professionally. Mayor Lund asked and received confirmation that the restaurant is currently open and serving food. He asked about Mr. Girmalul commented that he did operate a large restaurant in another country, but this is his first attempt in the U.S. He confirmed that he was aware of the 60/40 rule related to food and alcohol sales. Mayor Lund provided additional expectations for food service to be the main focus, noting that alcohol sales are not to continue past the time food is served. He noted the problems that existed for the business that previously operated in this location. Mr. Girmalul replied that if alcohol sales became an issue, he would simply stop serving those beverages. Councilmember Tillberry stated that the website for the business shows an event hall and asked if there is a separate license required for that. Ms. Kondrick commented that this license would cover the event hall as well. Councilmember Tillberry asked if Mr. Girmalul has experience selling alcohol. Mr. Girbalul commented that his restaurant in Nyrobi served alcohol and that operated for 20 years. He noted that this would be his first-time serving alcohol in the U.S. as this is his first restaurant in the U.S. Councilmember Bolkcom stressed that the City is very serious about the 60/40 rule for food and alcohol. She asked for more information on the type of food served and the training that would be provided for the staff serving alcohol. 34 Jufn!4/ City Council Meeting 4/8/2024 Minutes Page 4 Mr. Girmalul commented that they serve culturally diverse food. He stated that he would train all employees to check identification on all customers, regardless of age. He stated that they also have a time limit during which they would offer alcohol service, noting that his restaurant closes at 11 p.m. but the hours may be different for the event hall. He stated that event hall customers must also have food included in the service. Councilmember Ostwald asked if the restaurant caters for the events at the event center or whether an outside caterer could be used. Mr. Girmalul commented that generally they serve the food, but outside food is allowed with the proper catering licenses provided. He stated that his plan would be for beer and wine service but perhaps liquor in the future. Mayor Lund asked if there are any plans for remodeling or improvements on the exterior. Mr. Girmalul commented that they have invested in improvements to the interior, and he will now begin to improve the outside appearance. Councilmember Bolkcom asked if there is concern with the 60/40 ratio for those that use outside catering. Mr. Girmalul stated that he does have a plan to regulate alcohol service during those events. Mayor Lund noted that perhaps for events that would like alcohol service, the business requires that the restaurant is used for catering to ensure the 60/40 rule is met. Councilmember Evanson asked for details on staffing and management of the restaurant and event space. Mr. Girmalul provided details on his staffing, noting that once the business grows, he will continue to add more staff. He was aware that if someone else were added to management, they would need to be added to the liquor license. Ms. Kondrick presented a proposed amendment to Chapter 1 of the Fridley City Charter. She reviewed background information on the request, summarizing details of Chapter 1 along with the proposed amendments. She reviewed the next steps, should the first reading be approved. Mayor Lund invited any members of the public to provide comments. No public comments were provided. Ordinance No. 1422, Amending the Fridley City Code Chapter 105, Commissions, to Establish a Public Arts Commission. Scott Hickok, Community Development Director, provided background information on public art and the public engagement process that occurred thus far and the recommendation that moved forward to the City Council. He reviewed the proposed ordinance which would establish a Public Arts Commission. He reviewed the next steps, should the first reading be approved. Councilmember Tillberry asked if there would be a process to involve the new Commission in public projects to determine if there would be an opportunity to include public art. Mr. Hickok replied that there would be a staff liaison, currently identified as himself, and noted that it would be his responsibility to identify those opportunities. Councilmember Evanson asked for more information on the creation of a 501-3c organization and how that would work with this group. 36 Jufn!4/ City Council Meeting 4/8/2024 Minutes Page 6 Mr. Hickok explained that the 501-3c would be separate and operate independently with the purpose of fundraising to further the interest of public art. He stated that the Commission would be an advisory commission to the Council. He stated that the by-laws of the 501-3c would tie that organization to the Public Arts Commission. Councilmember Tillberry noted that it would be similar to the Springbrook Nature Center Foundation. Councilmember Bolkcom thanked the residents who have participated, noting the enthusiasm of the group. Motion made by Councilmember Evanson to approve the first reading of Ordinance No. 1422, Amending the Fridley City Code Chapter 105, Commissions, to Establish a Public Arts Commission. Informal Status Reports th Councilmember Bolkcom noted the 44 Avenue bridge discussion scheduled for the following night at City Hall. Councilmember Tillberry commented on the wonderful fundraising event that was held the previous Saturday at Springbrook Nature Center, hosted by the Springbrook Nature Center Foundation. The Council thanked the City staff and other volunteers who assisted in preparing and running the event. MINUTES Call to Order Mayor Lund called the Local Board of Appeal and Equalization meeting of April 8, 2024,to order at 7:00 p.m. Present Mayor Scott Lund Councilmember Dave Ostwald Councilmember Ryan Evanson Councilmember Tom Tillberry Councilmember Ann Bolkcom Others Present: Walter Wysopal, City Manager Patrick Maghrak, City Assessor Regular Agenda Item: New Business: 1.LBAE Resolution No. 2024-01, Approving the Equalization of Assessed Valuations of Real and Personal Property in the City of Fridley Patrick Maghrak, City Assessor, stated that the purpose of this meeting is to establish a consistent appeal procedure for the January 2, 2024,valuation or classification. He explained the actions the Council could take and noted that if property owners were not satisfied by the action of the Board, they could appeal further to the County Board. He reviewed the responsibilities of the Boardand the appeal procedures. He provided a summary of the 2024 assessmentfor residential properties, commercial and industrial properties, and apartments. Mr. Maghrak stated that he received a call this afternoon from a commercial property. He stated that he would not have had enough time to review the request, so they agreed to enter that appeal into the record to preserve their rightto continue to the County if desired. He provided additional exhibits to the Board to enter into the record, which show three properties that they changed values on in the last three days. He reported a total of fifteencalls received, four commercial/industrial, one apartment call, and nine residential calls. 39 Jufn!5/ Local Board of Appeals & Equalization 4/8/2024 Minutes Page 2 Councilmember Bolkcom asked why Home Depot waited until today to call. Mr. Maghrak commented that the letter is vague in stating that they should call the assessor. He noted that perhaps if additional language were added to the notice, that would clarify the process. Mayor Lund invited anyone present to provide their input if they wished to dispute their valuation. There was no one present to provide input. Motion made by Councilmember Bolkcom to approve LBAE Resolution No. 2024-01, Approving the Equalization of Assessed Valuations of Real and Personal Property in the City of Fridley, and Exhibit A, Estimated Market Value Changes, as presented. The motion passed unanimously. 3.!Updated Neighborhood Park Playground Design for Sylvan Hills Park Mr. Maher presented the 2024 neighborhood park playground concept design for Sylvan Hills which incorporates the input from the community and the theme. Commissioner Maow arrived during the staff presentation. Commissioner Maow asked for details on whether there would be any improvements to the areas outside the playground, such as the basketball court and tennis court areas. Mr. Maher replied that there is an updated site design for Sylvan Hills, but that is still being worked out with the stormwater management details. Advisory commissions provide for citizen input and are advisory to the Council. Advisory commissions shall have no decision-making authority, except as expressly established by the Fridley City Code or Minnesota Statutes (M.S.). 105.02 Commissions Generally 1. Membership (a)!Each commission, unless otherwise indicated, shall consist of seven Fridley residents appointed by Council. (b)!The Council will annually appoint, by Council resolution, a chairperson to each advisory commission. (c)!Each commission shall elect a vice chairperson. At any meeting of the commission if the chairperson is unable to attend, the vice chairperson shall act as chairperson. (d)!The commission members shall be appointed by the Council for three-year terms, except the Council shall make every effort to stagger the appointments so that the terms of no more than three members shall expire in any one year. Attempts shall be made to have all City wards represented on the commissions. Upon the expiration of their terms of office, members shall continue to serve until their successor shall have been appointed. 2. Vacancy Commission members may resign or be removed from office by a majority vote of the Council. Additional advisory staff shall be assigned to the commissions by the City Manager within the restraints of the adopted general fund budget. A Staff Liaison shall not serve as an appointed member of any City advisory commission. 5. Project Committees The commissions may establish special project committees to further the objectives of the commissions and provide for greater citizen participation. Such project committees shall be appointed by a commission for special projects and shall cease to exist when their activities are completed. The qualifications for membership, composition and duties of such project committees shall be at the discretion of the commission. The project committee may be chaired by a member of the commission, and at least one member of the commission shall act as a liaison for each project committee. 6. Compensation 61 Jufn!21/ The members of the commissions shall serve without pay, but may be reimbursed for actual expenses if funds therefore are provided in the adopted general fund budget. 7. Reports The commissions shall make such reports as requested by the Council. or Planning Commission. 8. Findings and recommendations shall be transmitted by the commission chairperson to the to the Council. 105.03 Planning Commission 1.!Commission Established There is hereby created a Planning Commission for the City of Fridley, Minnesota pursuant to M.S. Chapter 462. 2. Purpose (a)!The Planning Commission is established to provide comprehensive planning and zoning advice to the Council, provide a process by which the public may appeal staff interpretation of the Code, or request a variance to performance standards in the zoning chapters of the Code. (b) The Council hereby establishes the Planning Commission to serve as the Board of Appeals and Adjustments and exercise all authority and perform all functions of said Board pursuant to M.S. §§ 462.351 to 462.364 and operate according to this Code. 3. Scope (a)!The Planning Commission shall serve in an advisory capacity to the Council. Matters shall be referred to the Planning Commission by the Council, City Manager or chairperson of the member commissions, and may be assigned to the member commissions for detailed study and recommendations as required. All recommendations by the Planning Commission shall be made to the Council. (b)!The Planning Commission is charged with responsibility for community planning, growth and development of comprehensive goals and policies, including but not limited to, land use, housing, transportation, , and other related community activities. 62 Jufn!21/ (c)!The Planning Commission shall advise the Council in the development of programs to give increased effectiveness and direction in implementing established City goals and policies and recommend actions needed to carry out planning responsibility. 4. Appeals and Requests (a)!The Planning Commission shall hear and recommend to the Council appeals or requests in the following cases according to the procedures established in Chapters 128 and 205 of this Code: (1)!Appeals where it is alleged that there is an error in any order, requirement, decision, or determination made by a City compliance official in the enforcement of the Code, or State Building Code. (2)!Requests for variances from the literal provisions of Code in instances where strict enforcement would cause practical difficulties due to circumstances unique to the individual property under consideration. 5. Membership of Planning Commission The Planning Commission shall consist of the Planning Commission chairperson, the chairperson of the Parks and Recreation Commission, the chairperson of the Environmental Quality and Energy Commission, and four members at large. Nothing herein shall prohibit any Planning Commission members from serving on other commissions; however, none of these shall be elected as chairperson or vice-chairperson of any other commissions. 105.04 Parks and Recreation Commission 1. Commission Established There is established a Parks and Recreation Commission for the City. 2. Purpose The Parks and Recreation Commission is established to promote the systematic and comprehensive development of park facilities and recreational activities necessary for the physical, mental and emotional health and well-being of the residents of the City. 3. Scope 63 Jufn!21/ (a)!The Parks and Recreation Commission shall act as an advisory commission to the Council for continuous community planning and development of comprehensive City goals and policies. Any change in related community planning and comprehensive City goals and policies must be reviewed by the Council. (b)!The Parks and Recreation Commission shall advise the Council in the development of programs to give increased effectiveness and direction in implementing established City goals and policies and recommend actions as needed to provide park and recreational opportunities. 4. Program The Commission shall each year, prior to June 1, recommend a capital investment program for park improvement and acquisition and for public recreation activities for the ensuing year. 5. Funds For the purpose of financing the parks and recreation programs authorized by this Chapter, the accounting shall be the responsibility of the City Treasurer. The Commission shall be authorized to establish charges or fees for the restricted use of any facility or to make any phase of the recreation program wholly or partially self-sustaining. 105.05 Environmental Quality and Energy Commission 1. Commission Established There is established an Environmental Quality and Energy Commission for the City. 2. Purpose The Environmental Quality and Energy Commission is established to stimulate interest in and to promote an awareness of environmental and energy concerns among citizens and businesses of the City. It will serve as a resource to the City in the conservation and management of energy and the environment, including information on environmental problems, laws, policies, and regulations of the county, metropolitan, state, and federal levels to the extent of their effect on Fridley and advise the Council, the City Manager, and other appropriate City commissions on matters pertaining to conservation and management of energy and the environment, including the review and recommendation of programs and policies within the City. 3. Scope (a)!The Environmental Quality and Energy Commission shall act as an advisory commission to the Council for continuous community planning and development of 64 Jufn!21/ the comprehensive City goals and policies. Commission Established There is hereby created a Public Arts Commission for the City. 2. Purpose The Public Arts Commission is established to foster the development of the arts, to advise the Council on arts related matters and to stimulate participation in and appreciation of the arts by residents. 3. Scope (a) The Public Arts Commission serves in an advisory capacity to the Council on matters pertaining to visual public art within the City. Parks and Recreation staff will review ordersand work with sponsors to select bench locations that are compatible with park maintenanceand future improvements. 2.The donor may request bench installationin a specific park and may, in some cases, suggest a location withinthat park. Final placement of a bench is at the discretion of City of Fridley staff based on environmental conditions, utility locations and proximity of other bench amenities. 3.All costs related to a memorial/tribute bench purchase and installation must be paid in advance of bench purchase and installation of an inscribed plaque. Bench sponsorship may be made for a new or existing benchand all sponsorships are $2,500 4.An inscribed recognition plaquewill be affixed to the park bench. The City adopted Resolution No. 2022-126 on November 14, 2022, which terminated the agreement on November 14, 2023. During the term of the JPA, the County entered into grant agreements with the Metropolitan Council (MC) in order to receive funds from Minnesota Management and Budget (MMB) for the RCWRT and certain improvements within LP. These grant agreements required that either a joint powers agreement with the City be in place or that the County maintain a property interest in the RCWRT and LP. The City has agreed to provide the County with easements over the RCWRT in order to satisfy the property interest requirement of the grant agreements, provided the County allow the City to perform emergency maintenance on the trail and snow removal as deemed necessary by the City. The County agrees to install ADA improvements to the RCWRT by 2029. Since the RCWRT is a state bond-finance property, a declaration must be recorded against the properties containing the trail. MMB has agreed that provided the City execute and record a declaration for the LP property that indicates that improvements to the property have been financed by state grant funds, the City the City will be subjecting the property to the grant agreements, the MMB will besatisfied with the County not having a property interest in the LP property. As a result of the agreements, attached are the necessary documents that Council needs to approve in this matter: 1. When a property is replatted, the Subdivision Chapterof the City Code requires that drainage and utility easements be dedicated along the side and rear property lines. In 2023, the petitioner, NatashaLawrence reached out to City staff to inquire about combining the northern two lots, to create one large single- family lot, because the wetlands on the northern portion of Lot 3 made it difficult to be developed on its own. Staff advised that a simple lot combination form could be filed and recorded at Anoka County to make the two lots into one. A small portion of the new home will encroach intothe easement, so staff suggested that thetwofive-footside yard easements be vacated between Lots 2 and 3. The lot line that ran between the two lots no longer exists because of the lot combination, so there is no longer a need to retain the easements. Engineering staff have reviewed this request and have no concerns. Staff also notified private utility companies and no concerns were received from them. If the City Council approves the attached resolution, staff will notify the contractor of the award and issue a notice to proceed to the contractor upon receipt of acceptable submittals. Financial Impact Funding is provided by bond proceeds through the Capital Investment Program (CIP). The 2024 Neighborhood Improvements Project combined with the playground equipment and installation is approximately $257,250 under the approved 2024 CIP budget. This is a result of in-kind work performed by Parks Maintenance Staff that included miscellaneous site removals. Additionally, Engineering Staff provided in-house project design and contract administration through the bid solicitation phase. Construction administration and oversight will also be provided by Public Works Staff through project completion. A total of eight responsive bids were received. The2024 Street Rehabilitation Project No. ST2024-01is identified within the Cityof Fridley(City)annual street rehabilitation programandincludes the rehabilitation of portions of Lucia Lane, Channel Road, th 66Avenue, Norton Avenue and Buchanan Street. The total project length is approximately 1.28 miles. Roadway rehabilitationacross the project will include asphalt reclaimingand milling, asphalt pavingand concrete curb & gutter repairs. Additional roadway improvements include the termination and th construction of a cul-de-sac at the intersection of Lucia Lane and 68Place,as well as the construction of traffic calming measures along Channel Road. approximately 1,650 feet of watermain along Channel Road as well as the replacement of 12 fire hydrant assemblies across the project area. Additional utility improvements include the construction of a hydrodynamic separator device along Channel Road for stormwater pretreatment. As noted, eightbids were received (Exhibit A). The low bid was received from North Valley, Inc.of Nowthen, Minnesotain the amount of $1,211,092.08. This is 18% below of$1,480,112.50. The three lowest bids were competitive and within $65,371.60 of one another and the four lowest bids were within $102,897.36. Of the eight bids, the high bid received was $1,739,092.07. A project information sheet will provide a tentative work schedule, work description and contact information. Development Director Title Resolution No. 2024-55, Appointing Members to the Public Arts Commission Background In fall of 2023, the Cityof Fridley (City)hosted a series of public engagement meetings. These meetings were well attended and facilitated by Gretchen Nicholls and Barbara Raye, CDI, Minneapolis. The facilitators were instrumental in drawing out the creative notions of those whoattended. The goal of the sessions was to prepare a plan and recommendations for the Fridley City Council(Council)to help direct the initiative in a way the public saw identity moving. The final report was posted on the City website after theCouncil received the document in January of this year. Great things have grown out of the recommendations have a task force, creation ofa 501C3 non-profit as the fund-raising arm, and startingsmall with the installations so policy can form around the installations and the taskforce can make a final policy plan document that includes not only suggested art installation locations, but set policy for rotation (if appropriate), temporary installations, maintenance, etc. The task force has so enthusiastically taken on its role that the Mayor and Council have asked that the task force be formally recognized as the Fridley Art Commission. The council considered the ordinance to transition the group from a task force to a Commission at theApril 8 City Councilmeeting. ASecond Reading of that Ordinance will occur this evening. The Public Arts Commission will be established to foster the development of the arts, to advise the Council on arts related matters and to stimulate participation in and appreciation of the arts by residents. Membersto be appointed to the Commissioninclude Joshua Collins, Ryan Fugleberg, Gary Osterbauer, Frank Sedzielarz, Maija Sedzielarz and Gary Swanson. While still a task force, the future Arts Commission named the 501C3, FridleyCreative ArtsFoundation. The formative legal documents necessary for a 501C3 are being reviewed and prepared at this time. Financial Impact Meeting minutes will now be officially prepared,which isconsistent with the process of all other City administrative processes. Cost absorbed. It can be a variety of art forms and takes into consideration the site, its location and context, and the audience. Public art may possess functional as well as aesthetic qualities; it may be integrated or discreet. Artists may work in partnership with other design professionals or members of the community; however, the artist is directly involved in the concept, design, or creation. Performances, installations, events, and other temporary expressions are included in the definition; and Whereas, those engaged in the process created the following Mission statement: Empowering our vibrant community through the transformative power of public art, our mission is to cultivate a cityscape that celebrates diversity, creativity, and shared experiences. We are dedicated to fostering a sense of belonging, sparking dialogue and inspiring innovation through the strategic integration of art into our urban fabric, enhancing the quality of life for all residents and visitors; and Whereas, the public participants recommended the following; 1.!creation of an Arts Commission composed of people that understand art. 2.!Commissioners could include artists/creatives, business owners, community organizations, and others. 3.!Delay creating public art policies or ordinances until there is clarity from experience, and how to best guide or administer public art initiatives (e.g., how to accept donations or gifts, how to sunset art, etc.). 4.!Consider ways to integrate public art into capital projects where the city is already building infrastructure. 5.!Coordinate efforts with the Park System Improvement Plan to explore opportunities to incorporate public art in parks. 256 Jufn!31/ 6.!Other cities like Hopkins, Bloomington, Mankato, Minneapolis, and Saint Paul have models of governance bodies that oversee public art activities and offer important insights valuable to their cities; and Whereas, all members of the task force originally created in 2023, in response to the Public Arts engagement process have carried on their responsibilities admirably; and Whereas, members of that task force included Joshua Collins, Ryan Fugleberg, Gary Osterbauer, Frank Sedzielarz, Maija Sedzielarz and Gary Swanson, who all agree to loyally transition into their role as Public Art Commissioner.
